dc.description.abstractThis monograph paper, is a result of the growth of teleworking phenomenon due to the increasing use of the information and communication technologies as well as the rise of the COVID-19 Pandemic, have been allowing the provision of work activity outside the company’s facilities teleworking, therefore, the need to correctly set out the legal concept of workplace and working time for the purpose ofdetermine the legal regime of work accident in telework from home or telecentre or others. With the publication of law number 13/2023 of Agosto the 25th, the Labor law, we try to identify the Mozambican legal Regime of work accidents. Therefore the need to delimitate clearly the workplace and the working time, in distance work. In teleworking, the worker`s home, telecentre and others are the places considered to be the workplace, so, this research seeks to understand which method to accurate the existence of teleworking contract? As well as the legal regime in order to guarantee legal protection for the employer and the worker. The evident outcome of this survey is that the Mozambican legal regime of working accidents doesn’t foresee all the situations of this new regime considered teleworking, it takes to a conclusion that there is a legal gap regarding to teleworking.pt_BR

dc.description.resumoEsta monografia, surge no âmbito do crescimento do fenómeno teletrabalho movido pelo crescente uso das tecnologias de informação e de comunicação que com o advento da pandemia da COVID-19, que tem vindo a permitir a prestação da actividade laboral fora das instalações da empresa e em regime de teletrabalho, por isso, a necessidade de delimitação e determinação do local de trabalho e do tempo do trabalho para efeitos de caracterização de acidentes de trabalho no regime de teletrabalho no domicilio do trabalhador, telecentro e outros. Com a aprovação da Lei n° 13/2023 de 25 de Agosto, Lei do trabalho, procuramos entender qual é o regime jurídico moçambicano de acidentes de trabalho no âmbito do teletrabalho, assim a necessidade da delimitação clara do local e tempo de trabalho, no regime remoto. No teletrabalho, o domicílio, telecentro e outros passam a ser considerados espaços que representam local de trabalho, assim procura-se entender qual tratamento para apurar a existência ou não desta figura? Qual será o regime de descaracterização a fim de garantir a efectividade da protecção júridica. Deste estudo, resulta evidente que o regime moçambicano não prevê todas as situações de acidentes de trabalho para este novo regime, havendo lacunas na interpretação desta figura jurídica.pt_BR
