Abstract

This TFC discusses the disharmony between the legal institutes of repudiation of inheritance, subsequent succession vocation and subrogation by creditors of the person repudiating the inheritance. In essence, we were able to establish that, with regard to the subrogation by the creditors of the repudiant of the inheritance, under the provisions of art. 50, no. 1, of the LS, there is no true acceptance of the inheritance by those – creditors – on behalf of the latter – the repudiant –, but rather a forced legal solution, since once the inheritance has been refused, the repudiant becomes non-existent in the list of persons capable of succeeding the deceased. However, even so, his right of representation is not impaired, and his descendants are therefore called to occupy his place in the succession, as is clear from the combined terms of what is set out in arts. 45, in fine, 8, no. 2, and 15, all of the LS, as well as the fact that art. 8 of the LS, regarding the succession vocation, does not refer, at any time, to the possibility of the creditors of the priority heir being called to the succession in the event that the latter deems it better to refuse to succeed the deceased person.
